What happens if my ticket is not in the system
I guess I will just keep my fingers crossed. Of course, I would phone in on the day of the deadline to check up on my ticket just to make sure. I will also call the office to try to get a verbal agreement that I can infact ignore the ticket, incase the ticket shows up after my deadline or something. Of course for legal reasons I will record this call for legal reasons, just incase anything happens. Aug 4, 65, 5 Originally posted by: nobb Thanks for your quick replies. Oct 6, 1, 0 0. I had a lawyer friend explain to me how speeding tickets work.
The prosecutor knows he doesn't have the evidence needed so its a losing case, if a lawyer decides to fight the charge. Jack, try going to court with that argument OP, I don't know where you are at, but often, the cop writes a ticket, it gets turned in to his precinct, they send it to the county courts where it gets entered, and in much of Kahleeforneeya is also sent to an outside agency who actually mails you the notice with court date, bail fine amount, and the necessary contact information.
This process can take a couple of weeks It won't work for me I'm not a lawyer and do not know all the "tests". I do know there are a few books out there, but I do not claim to know all the ins and outs. Edit- If you google "beating a speeding ticket" there seems to be main different sites with information similar to that given to me by my friend the lawyer. Most of it has to do with calibration of the radar gun and training of the officer on using the gun.
Both most be tested and trained on a regular basis but are not. This gives you an "easy" defense if you take the ticket to trial. The other thing I remember my friend telling me about is speed limits must be checked on a regular basis as well and most often they are not.
This also gives you another "easy" defense if you go to trial. Again I do not claim to know everything and I have not tried any of these techniques myself. They are just information I was given by a lawyer friend and information I found on the internet.
Oct 17, 1, 0 For my speeding ticket from Jan, it took them obout 2 months before it showed up in the system. It wasnt even in the system by my court date so the clerk told me to keep checking to see if it turns up. I eventually got the courtesy notice a week or 2 after that. Sucked because they didnt give me a court date so i had to call and get one from them. TallBill Lifer. Just because it doesn't show up online doesn't mean the court date does not exist, and the judge is NOT going to accept "oh but I thought the ticket never made it into the system because it isn't on my computer" when writing your warrant.
Quoting mr. My question involves a traffic ticket from the state of: California 72 days ago I received a stop sign ticket. Quoting seki. Do NOT go by the web site. Quoting cdwjava. Appear in court as directed on the 19th.
If you can, try and get some proof of your appearance so that if your case is NOT called, then you can later show that you appeared as directed. I have heard more than one case on these forums where someone appeared and then received notice that they failed to appear.
Your obligation at this point is to appear as directed on the citation. Do so. If you FAIL to do so, then you can face additional consequences which generally involves a suspended license, but CAN in some situations result in an arrest warrant.
If you think you cannot appear on the 19th, consider what will happen if your license is suspended or an arrest warrant is issued. Your options are limited.
If you fail to appear, you could face the aforementioned consequences. Even if you hired an attorney, he cannot appear in your stead for the arraignment. If you refuse to appear you may get lucky and the cite will not yet have been filed STrange things can happen, which is why I always recommend that a defendant appear and try and get some proof of their appearance just in case the cite is later filed and the already passed court date is entered somehow and it flags as an FTA.
